The Vice President’s Dual Role
February 11, 2008 – 2:12 pm by ASVice President Cheney, as President of the Senate, has signed on to the bipartisan Congressional brief urging that the DC gun statute be found unconstitutional as a violation of the Second Amendment. The Executive Branch, of which the Vice President is also presumably a member, filed a brief a few weeks ago urging the Court to remand the case to the lower court so that it could use a more flexible standard of review.
